We recommend that you be wary of commercial proposals from third parties who represent themselves attributable to the Cornali Bergamo Jewelery, but operating on platforms other than ours, the official website www.cornalibergamo.it. For any doubts in this regard, you will want to contact us through the contacts available on our official website www.cornalibergamo.it. We would like to inform you that Gioielleria Cornali relies exclusively on banking institutions and circuits of primary importance operating on the Italian territory. In case of payment by bank transfer, we recommend that you always check the bank connected to the IBAN received by e-mail (even if the e-mail or invoice appears to arrive from Gioielleria Cornali).

 
ART. 1 - TERMS OF SALE AND WARRANTY

1.1 The conclusion of the order through www.cornalibergamo.it constitutes a purchase proposal by the Customer, which will be considered accepted only after explicit written confirmation from Gioielleria Cornali. It will be our pleasure to contact the customer to update him on all phases of order management.

1.2. The values ​​displayed on our site are to be considered as "prices per unit of goods", inclusive of VAT, unless otherwise specified. These may undergo changes for which we are not required to provide any notice. We generally consider our sales of our assets as “per piece” which cannot be divided by nature and faithful to the images of the website www.cornalibergamo.it with which they are represented. 

1.3. It is possible for our customers to purchase customized and / or made-to-measure goods, according to their taste, but which meet our quality criteria. In this case, the possibility of withdrawing from the purchase and sale contract of the asset will no longer be possible.

1.4. Once the acceptance of the online purchase proposal formulated by the Customer has been received by Gioielleria Cornali, the transfer value will not undergo any change. The e-mail confirming receipt of the order formulated by the Customer is sent automatically by the computer system and does not in itself constitute acceptance. All the goods, after the acceptance by Gioielleria Cornali of the order made by the Customer, will be available for collection at Gioielleria Cornali or delivered by shipment to the agreed address.

1.5. At the Customer's choice, all purchases for a total amount exceeding € 200.00 will be delivered free of charge (if on national territory). Shipping costs instead amount to € 15.00 for purchases of less than € 200.00. Deliveries outside the national territory must be agreed from time to time. We specify that, during transport, the goods are covered by primary insurance.

1.6. We also inform you that, after the purchase of a used good, Gioielleria Cornali will ask the Customer for a photocopy of the identity document in order to proceed with the correct management of the order in compliance with the current legislation on the sale of precious used items (Art. 128 TULPS ).

1.7. In addition to the guarantee offered by the manufacturer of the goods, they are also covered by the legal guarantee provided for by the Consumer Code Legislative Decree 6 September 2005 n. 206 except for the following cases, which are covered by the legal guarantee provided for by the Civil Code: (i) the customer purchases with VAT; (ii) the customer purchases as a non-mere consumer. It should be noted, however, that no guarantee is issued regarding the sale of used goods.

ART. 2 - METHOD OF PAYMENT

2.1. At the Cornali Jewelery points of sale, the payment methods are those permitted by the laws in force: bank account checks and / or cashier's checks, credit cards and / or cash within the limits established by current regulations, as well as advance bank transfer in the event that choose the delivery by courier.

2.2. For online purchases, the Customer can choose the NEXI XPAY primary circuit https://www.nexi.it/business/accipendenza-pagamenti/ecommerce.html, to be made within three days of receipt of the order acceptance confirmation; or within the same term at the Gioielleria Cornali bank details IT63F0503411102000000018979.

ART. 3 - RIGHT OF WITHDRAWAL - RETURN

3.1 The Customer is granted the right of withdrawal as required by current legislation. The deadline for exercising this right is fourteen days from the date of delivery of the products. By that date, the customer is required to send a registered letter with acknowledgment of receipt, in advance by fax and simple e-mail, to the Cornali Jewelery. Together and at the same time as said withdrawal notice, the Customer is required to physically return the goods to Gioielleria Cornali in the same conditions in which he received them, by means of a special means of transport and packaging designed to guarantee the integrity of the goods. Within ten days of receipt of the aforementioned registered letter and the goods, evaluates the timeliness of the return, assessed the conditions of conservation of the goods and related packaging and boxes, it will be the responsibility of Gioielleria Cornali to reimburse the customer.

3.2 The right of withdrawal is denied in the case of goods made to measure, as well as personalized, or still specially ordered at the request of the Customer.

ART. 4 - RIGHT TO PRIVACY

This Privacy Policy describes the ways in which we process the personal data of customers, collected through the site and is made, pursuant to art. 13 of EU Regulation 2016/679 ("EU Regulation") and Legislative Decree 196/2003 and subsequent amendments and additions, to those who interact with the services accessible electronically on the Site. The processing of personal data will be carried out by Gioielleria Cornali according to the principles of correctness, lawfulness, data minimization, transparency, storage limitation, integrity and confidentiality, in accordance with EU Regulation 679/2016. The data controller is Gioielleria Cornali.
The personal data provided by the customer by accessing the various sections of the site are the following: your name; address and telephone number; e-mail, credit card information; names of the recipients of the orders (addresses and telephone numbers included).

Gioielleria Cornali will process personal data for the following purposes:
a) respond to requests for information submitted through the site;
b) process customer purchases;
c) manage the purchase proposals formulated by customers;
d) provide after-sales assistance services for product repairs / replacements, even after activation of the warranty;
e) promote and advertise Cornali Jewelery products to customers;
f) send newsletters and other marketing communications regarding news, information and updates on our products and services, offers, promotions and special events and other marketing communications.

Any processing of the customer's personal data takes place on the basis of a legitimate reason for the processing. With regard to the purposes described above from a) to e), the processing and communication of personal data by Gioielleria Cornali does not require consent, as the processing is necessary for the execution of services requested by the customer, in the absence of orders from customers will not be able to be tried. As regards the purposes described above, on the other hand, letter f), the express consent of the customer is required, the absence of such consent will not affect the ability to purchase the goods of Gioielleria Cornali. The data processing will mainly be carried out with the aid of electronic or in any case automated tools (manual, computerized, and telematic), in the manner and with suitable means to guarantee the security and confidentiality of the data. The Data Controller informs that the personal data collected will be kept only for the time necessary to provide the services requested by the user or to fulfill the sales contract or to fulfill legal obligations and exercise their rights in any legal proceedings. Regarding the marketing and profiling purposes, the data will be kept for a period of 5 years. Pursuant to articles 15, 16, 17, 18, 19, 20 and 21 of EU Regulation 2016/679, at any time the Customer, upon request to Gioielleria Cornali, can exercise against the Owner of Gioielleria Cornali based in Bergamo via XX September n. 127 (CF 01563030160, PEC: cornalibergamo@pec.it), right of access, rectification, integration, cancellation, limitation, revocation, of all or part of the information / personal data in the possession of Gioielleria Cornali. Without prejudice to the right of the customer who believes that the processing of his personal data violates the rights regarding privacy, he can lodge a complaint with the Guarantor for the Protection of personal data, following the instructions that he will find on the website of the Guarantor: www.garanteprivacy.it .
